OLYMPIA, Wash. -- A legislator from Spokane was arrested over the weekend and has been cited for DUI.

Rep. Timm Ormsby, a Democrat, apologized for the incident, saying he made "a very poor choice this weekend."

"I have faith in our justice system, and will abide by whatever consequences I receive. Right now, I’m focused on my duties as a legislator: Drafting a state operating budget and serving the people I represent.”

He has served in the Legislature since 2003.

A Thurston County deputy was dispatched Saturday to 2239 58th Ave. N.W., in unincorporated Thurston County for a car crash.

A Jeep Cherokee had rolled. A police report said the Jeep had likely hit a culvert with enough force that it went airborne.

Ormsby was in a fire department aid car and said he had been distracted by a text message, which caused him to swerve and hit the culvert.

He said he had had two beers.

A DUI citation showed he had a blood alcohol content of at least 0.90. The state limit is 0.80.
