The King County prosecutor asked a judge to nullify the sentence for Darrion Holiwell, claiming Holiwell lied in court.
Holiwell pleaded guilty three weeks ago to acting as a pimp for his estranged wife, as well as stealing ammo from the sheriff's department and dealing drugs.
During sentencing, Holiwell's lawyer told the court he was broke, but investigators now say he had cashed in his retirement for $180,000 just weeks earlier. Prosecutors say Holiwell claimed he was broke in an effort to get a lighter sentence and that the court accepted the argument and used it in determining an appropriate sentence.
"His behavior is just another component of his continuing scheme to deceive any and all those around him," prosecutors wrote in their motion to have Holiwell resentenced.
If the judge grants a re-sentence, Holiwell could ultimately face 20 months behind bars.
